Terms & Conditions
These Terms & Conditions ("Terms") govern your use of Switch and Save Smart Cart (the "App") provided by MageBytes ("we", "us", "our"). By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
1. The service
The App lets Shopify merchants create swap groups and price rules so shoppers can replace a cart item with a suggested alternative product. Features available to you depend on your selected plan.
2. Eligibility and account
You must have an active Shopify store and comply with Shopify's Terms of Service. You are responsible for all activity under your store and for the accuracy of the products, prices and rules you configure.
3. Plans, billing and cancellation
- The App offers a Free plan and paid plans billed monthly or yearly through Shopify Billing.
- Charges appear on your Shopify invoice. Prices and plan limits are shown on the App's Plans & Billing page.
- You can upgrade, downgrade or cancel at any time. Uninstalling the App cancels your subscription.
- Except where required by law, fees already paid are non-refundable.
- When you reach your plan's monthly swap offer limit, offers pause until the next billing month or until you upgrade.
4. Acceptable use
You agree not to:
- Use the App for any unlawful purpose or in violation of Shopify's policies.
- Reverse engineer, copy, resell or interfere with the App or its infrastructure.
- Use the App to show misleading prices or product information to shoppers.
5. Your data
You keep ownership of your store data. You grant us a limited licence to process it only to provide the App. Our handling of data is described in our Privacy Policy.
6. Intellectual property
The App, including its software, design and content, is owned by MageBytes and protected by intellectual property laws. We grant you a non-exclusive, non-transferable right to use the App while it is installed on your store.
7. Disclaimer
The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free or compatible with every theme, or that it will increase your sales.
8. Limitation of liability
To the maximum extent permitted by law, MageBytes is not liable for any indirect, incidental or consequential damages, or for lost profits or revenue, arising from your use of the App. Our total liability is limited to the amount you paid for the App in the three months before the claim.
9. Termination
You may stop using the App at any time by uninstalling it. We may suspend or terminate access if you breach these Terms. On termination, your data is deleted as described in the Privacy Policy.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect means you accept the updated Terms.
